Dirt - Any dirt, earth fill, green waste, sand, gravel or building waste as specified which is not considered by the relevant local authority as being contaminated
Want Dirt - those listings where the lister needs dirt
Got Dirt - those listings where the lister has got dirt
Dirt Job - The movement of dirt from one location to another based on the Want Dirt and/or Got Dirt listings as agreed by the relevant parties
Locality - approximate distances are taken from a point in the locality chosen - this is a straight line distance and should not be relied upon as the travelling distance. The accuracy may vary depending on the points to and from.
Users - any person or business who uses the Dirtdatabase.com website for any purpose
System - the Dirtdatabase.com web application which enables lists and provides other advertised services
Basic Service - Want Dirt and Got Dirt listings, free email notification, and one free directory listing
Free - References to free use of services means free use of the Basic Services of the Dirtdatabase.com website once the user has access to the internet, but subject to thse terms of use and other policies which may be posted on the Dirtdatabase.com and Smart Space websites.
Dirtdatabase.com Operations
Dirtdatabase.com is a service based website which
- Allows the public to create listings when they have got dirt or want dirt.
- Provides certain tools which enable those who Want Dirt and those who have Got Dirt to contact each other for the purposes of coming to an agreement on a Dirt Job.
Dirtdatabase.com does NOT
- Supply dirt
- Arrange the delivery of dirt
- In any way handle, dig up, transport or spread dirt
- Check the authenticity or the accuracy of the listings
- Have any involvement whatsoever in agreements on any Dirt Jobs
- Accept commissions from any businesses or individuals for successful dirt listings
Making Listings
Anyone who is registered in the Smart Space system can make a Want Dirt or Got Dirt listing on Dirtdatabase.com subject to the following:
- Users accept the system "as is" with the possiblility that the system may not be suitable for the purposes that users may use it for
- The dirt is not contaminated as determined by any relevant authorities
- Any permits or licences required for the movement of the dirt are obtained as required by the local law
- The listing details are an accurate representation of what is known about the dirt at the time of the listing
- Further relevant information which may come to light after the listing is included in the listing in a timely way
- There are no hidden costs associated with the completion of the Dirt Job which are not made clear in the listing
- Parties understand that listings are general in nature and specifics of any Dirt Job need to be agreed to between the relevant parties before the Dirt Job is commenced.
- Dirtdatabase.com plays no part and is not responsible for any aspect of a Dirt Job
- Dirtdatabase.com cannot be held liable for any loss or damage caused by any failure of the system either directly or indirectly
- Users will manage listings to ensure accuracy of information provided
- Listings will not contain any material or content which could be considered racist, obscene or pornographic, the judgment to be made by Dirtdatabase.com at its complete discretion
Dirtdatabase.com Rights
Dirtdatabase.com reserves the right to:
- Alter these Terms of Use without notice
- Delete any listing at its complete discretion and without notice
- Cease or alter its operations without notice
- Introduce new paid services in addition to its basic free services at any time and without notice
Dirtdatabase.com Responsibilities
Dirtdatabase.com gaurantees that:
- It never provides personal or business details to any third parties unless it is required to do so by law
- It will not provide any personal or business details to any related entities without their express consent
- It will do its best to provide a reliable service whilst acknowledging that it cannot gaurantee 100% uptime
- At all times, it will act in an ethical manner and within the bounds of the law of the State of Queensland in Australia
- Its basic service will remain free whilst the site exists
